Acceptable Use Policy (AUP)

1. Purpose and Scope
This Acceptable Use Policy ("AUP") outlines the strict guidelines, prohibited behaviors, and compliance protocols for all clients, integrators, and third-party partners utilizing XDA Technologies' communication infrastructure. This includes, but is not limited to, our bulk SMS gateways, USSD endpoints, OTP delivery systems, transactional APIs, and digital voucher platforms. This policy protects the integrity of our network, ensures high deliverability rates, and ensures compliance with global telecommunications regulations.
By using our Services, you agree to adhere to this AUP. XDA Technologies reserves the right to modify this AUP at any time to align with evolving regulatory frameworks and emerging threat landscapes.
2. Zero Tolerance for Spam and Unsolicited Messaging
XDA Technologies enforces a strict, zero-tolerance policy against Spam. You may only transmit messages to recipients who have explicitly opted-in (provided express, verifiable consent) to receive communications from your organization.
- Purchasing, scraping, trading, or utilizing unverified third-party mobile number lists is strictly prohibited.
- All promotional or marketing campaigns must include a clear, functional, and free opt-out (unsubscribe) mechanism.
- Opt-out requests must be honored and processed immediately.
3. Prohibited Content and Activities
Under no circumstances may you use XDA Technologies' APIs or infrastructure to transmit, promote, host, or facilitate any of the following content or activities:
- Phishing and Fraud: Messages designed to socially engineer or trick recipients into revealing personal data, financial information, passwords, or PINs (e.g., fake bank alerts, fraudulent mobile money reversal scams, "Smishing").
- Illegal Activities: Content that violates local, national, or international laws, including the promotion of illicit drugs, contraband, counterfeit goods, or unlicensed firearms.
- Unlicensed Gambling & Lotteries: Promoting betting or lotteries without verifiable authorization from the relevant national Gaming Commissions.
- Malicious Code: Distributing malware, viruses, trojans, or linking to corrupted, malicious websites.
- Adult and Explicit Content: Sexually explicit material, pornography, or the promotion of escort and prostitution services.
- Hate Speech & Harassment: Content that promotes violence, discrimination, or intimidation against individuals or groups based on race, religion, gender, sexual orientation, or national origin.
4. Sender ID Spoofing and Misrepresentation
You must not spoof or forge Sender IDs (Alphanumeric or Numeric headers) to masquerade as another entity, brand, government body, or financial institution without explicit, documented authorization. All customized Sender IDs must be registered, vetted, and approved by XDA Technologies and the respective telecom authorities prior to use.
Impersonating a bank, mobile money operator, or government agency carries severe criminal penalties, and all such attempts will be reported directly to law enforcement.
5. High Volume & Infrastructure Stress Restrictions
Clients are prohibited from intentionally overloading our APIs through aggressive load testing, unauthorized penetration testing, fuzzing, or DDoS simulations without prior written consent from our engineering team. All security auditing and stress testing must be coordinated, scoped, and scheduled in advance.
Clients must adhere to the documented API rate limits applicable to their account tier. Circumventing rate limits via IP rotation or multiple accounts is a violation of this AUP.
6. Enforcement, Throttling, and Account Termination
XDA Technologies employs advanced automated filtering algorithms, AI-driven heuristic analysis, and manual compliance audits to enforce this policy. We reserve the absolute right to:
- Filter, block, or drop messages that violate this AUP silently and without notifying the sender.
- Throttle throughput or temporarily suspend accounts exhibiting abnormally high bounce rates or generating carrier complaints.
- Immediately and permanently terminate API access and accounts found in severe violation of this policy.
- Confiscate remaining wallet balances of terminated accounts to offset fines levied by downstream carriers.
- Report severe violations (such as financial fraud, Smishing, or phishing) to the relevant telecom regulators, law enforcement agencies, and the Bank of Ghana where applicable, fully cooperating with criminal investigations and providing necessary logs.
7. Reporting Abuse
If you believe a client of XDA Technologies is violating this policy, or if you have received unsolicited or fraudulent messages originating from our infrastructure, please report it immediately so our Security Team can investigate and take swift action.
